SAWYER COUNTY -- The Court has sentenced Vicki Hirtreiter, the 3rd person sentenced on convictions from a 2020 burglary in Sawyer County.
Criminal charges were filed in Sawyer County Circuit Court against Hirtreiter and two others, Larry Rush and Steve Martin, in October 2020 following an investigation into a burglary at the Black Iron Bar and Grill in the Town of Spider Lake.
Sawyer County Deputies assisted by the City of Hayward Police and the LCO Police Department responded to a 911 call on October 08, 2020, of a burglary in progress at the Black Iron Bar and Grill located at 12131W State Highway 77 in the Town of Spider Lake. Deputies were told that two suspects wearing masks were attempting to break into the bar before fleeing into a wooded area. Ultimately Hirtreiter, Rush, and Martin were all located and arrested in relation to the burglary.
Hirtreiter was charged with Class F Felony Attempted Burglary to Building or Dwelling, Party to a Crime; Class I Felony; and Misdemeanor Possession of Drug Paraphernalia.
Online circuit court records show that a Jury Trial was scheduled for October 2022 regarding the case filed against Hirtreiter, however, she appeared on July 13, 2022, for a plea and sentencing hearing regarding her charges.
The Hon. John Anderson accepted Hirtreiter’s plea of No Contest to her charge of Class F Felony Attempted Burglary to Building or Dwelling, Party to a Crime. The remaining charges against her were dismissed but read-in.
Hirtreiter received a withheld sentence with 18 months of probation and 14 days of conditional jail time with credit for time served. Conditions of probation will require Hirtreiter to undergo an Alcohol and Other Drug Assessment within 45 days and follow through with recommendations.
Hirtreiter still faces additional criminal charges in a Price County Circuit Court case for Class H Felony Bail Jumping; Misdemeanor Bail Jumping; and Misdemeanor Possession of Drug Paraphernalia. She is to appear again in August 2022 regarding those charges.
Larry Rush previously received two concurrent prison sentences for two convictions of Burglary to Building or Dwelling; he is to serve 3 years of initial confinement followed by a total of 4 years of extended supervision.
Conditions of supervision will require Rush to undergo an Alcohol and Other Drug Assessment within 45 days and follow through with recommendations. He will also be required to pay over $1,200 in costs and fees.
Rush has additional charges for burglary, theft, and receiving stolen property still pending against him in Iron County Circuit Court and Ashland County Circuit Court, according to online circuit court records.
Steve Martin previously received withheld sentences for his convictions of Class F Felony Attempt Burglary to Building or Dwelling; Class I Felony Possession of Methamphetamine; and Misdemeanor Theft.
Martin is to serve 4 years of probation with conditions requiring him to complete an AODA assessment and any counseling and programming deemed appropriate by his Department of Corrections agent and follow through with recommendations.
Martin was also sentenced on similar charges in Iron, Ashland, Outagamie, and Marinette counties, and was ordered to serve over 100 days in county jail and comply with conditions of probation.
Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
